Immigration-related penalties will be increased for inflation effective August 1, 2016. The new rules apply to violations occurring after November 2, 2015, and assessments issued after August 1, 2016 (previous penalty levels remain for penalties and assessments issued prior to that date).
For I-9 paperwork violations, the penalty range will increase to a range between $216.00 and $2156.00. Additional increases are expected for unlawful hires (up to $4313.00 for first offense; $10,871.00 for second offense; $21,563.00 for third and subsequent violations). For I-9 related discrimination and document abuse, the new penalty range will increase to a range between $178 and $1,782.
H1B employers face increased penalties for Labor Condition Application (LCA) violations (with increased penalties ranging between $1782.00 to $50,753.00 depending on the violation).
