On Friday, July 29, 2016, the U.S. Department of Homeland Security (DHS) issued a rule that expanded eligibility for the I-601A provisional waiver application. It will be effective August 29, 2016.
The provisional waiver process individuals inside the U.S. to file a waiver with USCIS prior to leaving the U.S. If approved, the waiver is used at the immigrant visa interview at the U.S. Embassy to allow the individual to return to the U.S. Previously, the waiver was only available to individuals with U.S. citizen spouses or parents. Now, individuals can apply with lawful permanent resident (LPR) spouses or parents.
